Terms and Conditions

These terms govern your use of SurfSearch. By creating an account or continuing after accepting these terms, you agree to them. If you do not agree, do not use the service. SurfSearch is intended for users aged 18 or older, or minors using it with a parent or guardian’s permission.
1. Surf and weather information
Forecasts, tides, wave heights, wind, water temperatures, best-window suggestions, and community reports are estimates or user-submitted observations. They may be delayed, incomplete, inaccurate, or unavailable. They are not safety warnings or a substitute for checking official weather and marine advisories, local conditions, lifeguard instructions, and your own ability. Surfing, swimming, and other ocean activities carry serious risks. You are responsible for deciding whether conditions are safe for you.
2. Your account
Provide accurate account information, keep your sign-in details secure, and tell us if you suspect unauthorized access. You are responsible for activity through your account. You may not impersonate others, interfere with the service, scrape it abusively, or use it unlawfully. We may restrict accounts that break these terms or threaten the safety of others.
3. Community posts and photos
You keep ownership of the reports, comments, ratings, photos, and other content you submit. By posting, you grant SurfSearch a non-exclusive, worldwide, royalty-free licence to store, display, and share that content within the service for as long as it remains posted, including copies needed to operate the service. You confirm you have permission to post it. Do not upload illegal, misleading, abusive, harassing, privacy-invasive, or copyright-infringing material. We may review, remove, or limit content or accounts that violate these rules. You can delete your own posts and photos using the available controls.
4. Saved information and privacy
SurfSearch stores account details and the information you choose to add, such as favourites, boards, session logs, and reports, to provide the service. Public posts and profile information may be visible to other members; private saved spots are intended for your account only. Do not share sensitive information in public content. You may contact us about access to, correction of, or deletion of your personal information. Personal information is handled in accordance with applicable South African privacy law, including POPIA.
5. Premium and payments
SurfSearch Premium is offered at R70 per month unless a different price is clearly displayed before checkout. Payments and recurring billing are handled by Paystack. Premium renews automatically until cancelled. You can cancel from your account’s Subscription & Billing section; cancellation stops future renewals and paid access ordinarily continues until the end of the paid billing period. Complimentary access may be granted or removed separately and does not cancel a paid subscription. Applicable consumer-law rights, including any mandatory cancellation or refund rights, are not limited by these terms. Contact us if a payment appears incorrect.
6. Availability and liability
We aim to keep SurfSearch available, but cannot promise uninterrupted access or perfect data. To the extent permitted by law, SurfSearch is provided as available without warranties, and we are not liable for losses caused by reliance on forecasts, community content, or temporary service interruptions. Nothing in these terms excludes liability or rights that cannot legally be excluded under South African law.
7. Changes and contact
We may update these terms as the service changes. Material updates will be presented for your agreement before you continue using the app. South African law governs these terms, subject to applicable consumer protections.
